License agreement

§ 1
DEFINITIONS

  1. In the text of this contract, the following words and symbols should be understood as follows:
    1. 4mage - AN INTERACTIVE DIMENSION ADAM SZEWCZYKOWSKI based in Psary, ul. Wiejska 54, 42-512 Psary, NIP: 6252408399, REGON: 243570539.
    2. User - a person who comes into possession of the module developed by 4mage to which this Agreement is attached.
    3. Agreement - this license agreement.
    4. Module - a module for Magento developed by 4mage.
    5. Using the Module - means any use of the Module by the User, including its download, installation, configuration, copying, updating or logging into the administration panel.
    6. Website - single installation of Magento software.

§ 2
SUBJECT OF THE AGREEMENT, CONCLUSION OF THE AGREEMENT

  1. The subject of the agreement is 4mage granting the User an indefinite license for the Module on the terms described in the further part of the Agreement
  2. 4mage declares that it is the creator and the sole and exclusive entity authorized to license and deliver the Module.
  3. The Agreement regulates the rules of using the Module.
  4. 4mage declares that he is entitled to exclusive proprietary copyrights to the Module in the full scope, without any restrictions to third parties.
  5. The Agreement is concluded between 4mage and the User when 4mage makes the Module available to the User, after the User pays the license fee.
  6. By using the Module, you accept the terms of the Agreement.

§ 3
FIELDS OF USE, RESTRICTIONS

  1. 4mage, subject to the following conditions, grants the User a paid, non-transferable, non-exclusive license for the Module throughout the world in the fields of use such as:
    1. installation of the Module on the Website,
    2. using the Module to run the Website,
    3. storing any number of Module backups, where these copies must be secured against access by third parties,
    4. purchase of a temporary update to improve or add new functionality to the Module.
  2. The license is granted only for use on the Website, the address or addresses of which are given in the order. In the event of a change of address, the User is obliged to inform 4mage about it before this change via the e-mail address:
  3. The license covers only the Module in the version purchased by the User. Updates, except for updates provided by 4mage for a period of 3 months from the moment of purchasing the Module, are payable.
  4. The User has no right to use the Module for illegal purposes and the terms of the license, in particular to resell, disassemble the Module, its public presentation or granting further licenses, as well as to disclose technical information about the Module to third parties.
  5. If the User breaches any of the provisions of this Agreement, or if the User acts to the detriment of 4mage, 4mage may deprive the User of his license rights. 4mage may also seek compensation for damage on general terms, resulting from the User's actions inconsistent with the provisions of this Agreement.
  6. Each User using the Module is obliged to read the content of this Agreement always available in electronic version on the 4mage.co website, comply with its provisions, and in the event of disagreement with any of its provisions, immediately cease using it, subject to the content of § 5.
  7. Each User using the Module accepts that the number of licenses purchased from 4mage must be consistent with the number of Magento installations of the User.
  8. The User has no right to remove or change the following in the Module:
    1. information about 4mage,
    2. 4mage logo,
    3. names of files, classes, variables including 4mage, ForMage and IntW,
    4. links to the 4mage website.

§ 4
MODULE INFORMATION AND RESPONSIBILITY

  1. The module is a separate software from Magento, and for its correct operation it is necessary to install the Magento software in the version for which the module is intended.
  2. The User can install and configure the Module by himself.
  3. Selected modules require IonCube Loader.
  4. 4mage provides the User with descriptions of detected errors, which are recommended to be corrected in the Module.
  5. 4mage is responsible only for damages resulting from errors of the Module caused by the fault of 4mage, including damages directly resulting from the use or inability to use the Module, for data loss or inaccurate data, or for losses incurred by the User or third parties, limited to the value for which the Module was purchased. Reporting an error in the operation of the Module to 4mage is possible via e-mail at the following address: 4mage will make every effort to remove any defects without undue delay.
  6. 4mage is not responsible for any resulting damages

§ 5
TERMINATION OF THE CONTRACT

  1. Termination of the Agreement means that the User ceases to use the Module. Each User may terminate the Agreement at any time. The termination of the contract by the User obliges him to immediately stop using the Module and uninstall it, and in the event of a breach of the Agreement, compensate all its provisions, including in particular repairing the damage.
  2. In the event of a breach of the Agreement by the User, 4mage will call the User to cease the breach and to remedy the resulting damage by setting an appropriate date. After the expiry of the deadline set for the User, 4mage will be entitled to terminate the Agreement immediately. Then the current User is obliged to immediately stop using the Module and remove it immediately and repair the resulting damage. Further use of the Module by the User is tantamount to a breach of this Agreement and obliges the User to immediately repair the resulting damage.
  3. Termination of the Agreement by the User does not give rise to any obligations on the part of 4mage, in particular the reimbursement of any costs of purchasing or using the Module incurred by the User.

§ 6
ADDITIONAL AND FINAL PROVISIONS

  1. Any changes to this agreement, additional arrangements with the User, require written or electronic form, otherwise null and void, and must be expressly confirmed by both parties. Statements of will submitted electronically for the purposes of this license are identical to those made in writing.
  2. The User may modify or update the Module under the conditions set out in the Agreement.
  3. The name and designation of the Module are legally protected.
  4. This Agreement shall be governed by and interpreted in accordance with Polish law.
  5. Disputes arising from this Agreement, and not settled through negotiations, shall be settled by a competent common court.
